Мета вивчення дисципліни: The purpose of studying the academic discipline: based on the analysis of the norms of international law and the current legislation of Ukraine, to determine the essence and concept of gender equality, to consider the problem of discrimination of women's rights and ways to overcome it, to investigate the development of the principle of equality of rights and opportunities for women and men in legislation, as well as to develop proposals and recommendations on the introduction of the principle of gender equality into the national legal system; to develop attitudes towards the realization of the ideals and values of the development of a democratic society in the world; to prepare students for an active position regarding the realization of the ideals and values of the development of a democratic society in the world, Europe, and Ukraine. Cultivate responsibility for preserving peace and human rights.
Завдання: Integral competence (INT): the ability to solve complex specialized tasks and practical problems in the field of professional legal activity or in the course of training, which involves the application of legal doctrines, principles and legal institutions and is characterized by complexity and uncertainty of conditions. General competencies (GC): GC 1. The ability to realize one's rights and responsibilities as a member of society, to be aware of the values of a civil (free democratic) society and the need for its sustainable development, the rule of law, the rights and freedoms of a person and a citizen of Ukraine; GC 8. Ability to work in a team; GC 11. Тhe ability to realize equal opportunities and gender issues. Special (professional) competencies (РC): РC 16. The ability to guide students to progress and achieve; РC 21. The ability to carry out professional activities in compliance with the requirements of legislation, education standards and internal normative documents of the educational institution; РС 29. Respect for the honor and dignity of a person as the highest social value, understanding their legal nature.
Learning outcomes: Program learning outcomes (PL): PL 01. To be able to use the tools of a democratic legal state in professional and public activities, to make decisions based on relevant data and established value guidelines; PL 04. Understand the peculiarities of communication, interaction and cooperation in international cultural and professional contexts; PL 08. Independently plan and organize own professional activities and activities of students and subordinates; PL 15. To have the skills of stimulating cognitive interest, motivation to study, professional self-determination and self-development of students of education; PL 26. Ensure equal opportunities and adhere to the principles of gender parity in professional activity; PL 28. Demonstrate knowledge and understanding of the main modern legal doctrines, values and principles of functioning of the national legal system.
Required prior and related subjects: The previous subjects: - Related and following disciplines: Psychology; History of the state and law of Ukraine; Civil law and process; Criminal Law.
Summary of the subject: Successful development and formation of the modern legal system of Ukraine should be based on awareness of the value of human life, the importance of full and harmonious development of each individual, ensuring human rights, and the need to create conditions for self-realization of human potential. This is possible only if gender equality is ensured. The idea of gender equality is an integral part of equality, development and world peace. Without it, it is impossible to establish the foundations of democracy, freedom, justice and tolerance. Today, the issue of ensuring equal rights of men and women is one of the key issues in the overall context of the establishment of human rights and freedoms. The activities of international organizations and the adoption of international acts are largely aimed at achieving this goal. Despite a significant number of international legal acts, the activities of international institutions, and the long-standing practice of legislative ensuring equal rights for men and women, even today Ukrainian society is burdened with gender stereotypes, biases, sexism, and gender discrimination. Changes are needed at the level of public consciousness, governance, forms, methods and mechanisms for promoting and ensuring gender equality.
Опис: 1. Main categories and concepts of gender equality. Definition of the concept of "gender". The relationship between gender equality and women's rights. Legislative conflicts are related to the concept of "gender equality". 2. Stereotypical ideas about men and women and ways to overcome them. Socially determined characteristics of male and female understanding. Social expectations in the formation of a "real" man, a "real" woman and legal regulation of gender equality. Gender biases in women's professional activities. Gender asymmetry in language: legislative regulation of the use of feminine forms in Ukraine. 3. The role of international and national institutions in ensuring gender equality. Ensuring gender equality as a prerequisite for the European integration of Ukraine. The influence of international organizations on the establishment of gender equality. European organizations in ensuring gender equality. Consolidation and provision of gender equality at the level of national legislation. 4. Gender equality in electoral legislation. Gender balance in politics (or how gender quotas work). The beginning of women's struggle for suffrage in Europe (Great French Revolution). Suffragism as a form of struggle for suffrage in Great Britain. 5. Women in a democratic world. Participation of women in political power in Europe. The role of political parties in the OSCE countries in ensuring gender equality in politics. 6. Emergence of the idea of gender equality in Ukrainian legal thought. The idea of gender equality as a component of the national development of the Ukrainian people. Gender equality as a condition of spiritual, cultural and intellectual development of Ukrainian society. The Ukrainian women's movement and its role in the development of gender equality. 7. Civil society through the lens of gender issues. The role of women in civil society in the works of ancient Greek philosophers. Women's rights in the human rights system: general, specific. Men's rights in the human rights system. 8. Labor relations and relations in the field of employment: gender analysis. Male and female employment: the influence of gender on the choice of profession. Legislative principles for regulating gender equality in labor relations. The role of international legal treaties in promoting and establishing gender equality in labor relations. European prison rules and recommendations for improving the conditions of detention of women in prisons. 10. Ensuring gender equality in family legal relations. Marriage and types of marriages in Ukraine. Marital legal relations as a special type of family legal relations. Rights and obligations arising from a spouse as a result of a registered marriage. 11. Gender-oriented budgeting. Gender-oriented budgeting in the context of the implementation of Ukraine's international and national obligations in the field of human rights and the achievement of gender equality. Modern international approaches and tools for implementation of gender-oriented budgeting. 12. Violence in the family, forms of domestic violence. Domestic violence. Forms of domestic violence. Gender stereotypes as a risk factor for deviant behavior. 13. The Convention on the Elimination of All Forms of Discrimination against Women - history of adoption and principles of operation. History of the adoption of the UN Convention on the Elimination of All Forms of Discrimination against Women. Characteristics of CEDAW as an international treaty in the field of human rights protection. 14. Gender-legal examination of legislative acts and drafts of normative legal acts. Meaning and main tasks of gender-legal expertise. Stages of gender-legal expertise. 15. Experience of foreign countries in building gender strategies. Gender equality in Sweden. Gender equality in Finland. Gender equality in EU countries.
Assessment methods and criteria: The methods of assessing the level of achievement of learning outcomes of education seekers are: oral survey at practical (seminar) classes; control work; performance of an individual research task; final control work.
Критерії оцінювання результатів навчання: Evaluation of the student's learning results is carried out based on PC results in accordance with the 100-point evaluation scale established at the University. Current control (PC): practical (seminar) classes – 40 points; written test – 10 points; final test – 50 points.
Порядок та критерії виставляння балів та оцінок: 100–88 points – (“excellent”) is awarded for a high level of knowledge (some inaccuracies are allowed) of the educational material of the component contained in the main and additional recommended literary sources, the ability to analyze the phenomena being studied in their interrelationship and development, clearly, succinctly, logically, consistently answer the questions, the ability to apply theoretical provisions when solving practical problems; 87–71 points – (“good”) is awarded for a generally correct understanding of the educational material of the component, including calculations, reasoned answers to the questions posed, which, however, contain certain (insignificant) shortcomings, for the ability to apply theoretical provisions when solving practical tasks; 70 – 50 points – (“satisfactory”) awarded for weak knowledge of the component’s educational material, inaccurate or poorly reasoned answers, with a violation of the sequence of presentation, for weak application of theoretical provisions when solving practical problems; 49-26 points - ("not certified" with the possibility of retaking the semester control) is awarded for ignorance of a significant part of the educational material of the component, significant errors in answering questions, inability to apply theoretical provisions when solving practical problems; 25-00 points - ("unsatisfactory" with mandatory re-study) is awarded for ignorance of a significant part of the educational material of the component, significant errors in answering questions, inability to navigate when solving practical problems, ignorance of the main fundamental provisions.
