Learning outcomes: Know the history of substantive and procedural law and its origins; topical, problematic issues of current criminal law, procedural law; correctly understand, interpret and apply the rules of criminal, criminal procedural law, analyze judicial practice; to formulate various recommendations concerning the qualification of criminal offenses, proceedings in the case; analyze theoretical developments in the field of substantive, procedural law and draw independent conclusions. Know the scientific concepts and trends in substantive and procedural law in Ukraine; the main problems of the doctrine of criminal law and judicial practice, as well as the prospects for further development and improvement of criminal law and process.
Required prior and related subjects: Criminal law, criminal procedure. Workshop on preparation of procedural documents, Evidence in criminal proceedings, Fundamentals of criminal law qualification.
Summary of the subject: Course "Actual problems of criminal law and procedure (judicial practice)" - studies current legislation, practice and science of criminal offenses and punishment, current procedural law, procedural activities, theory and history of criminal law and procedure, judicial practice. It involves the study of a set of criminal law, procedural legal institutions and theoretical provisions, an array of both the practice of national courts and international courts. The discipline is based on substantive and procedural law, the practice of its application and the science of criminal law and procedure. Perfect knowledge of criminal, procedural legislation of the state is a necessary condition for successful work in courts, law enforcement agencies, during legal practice. Based on previously acquired knowledge of basic legal institutions, categories and concepts of criminal law and procedure, students must not only understand but also analyze case law, problematic issues of the course, offer their sound proposals to current legislation. The trajectory of monitoring for the study are patterns and trends in criminal law, process, their principles (principles), current issues of theory and practice, the effectiveness of procedural form and procedural guarantees of justice, the status of relevant actors, human rights and freedoms, The discipline is based on the study and generalization of judicial and investigative, prosecutorial and legal practice, which is its subject.
Assessment methods and criteria: Methods of diagnosing academic success, forms of measuring the level of knowledge acquisition in the discipline are: - oral examination in practical (seminar) classes; - presentation at practical (seminar) classes (with an abstract, report, discussion, etc.); - testing students' knowledge on the relevant topic of the lecture course; - written test (answers to theoretical questions, solving practical problems (cases), test tasks, etc.); - performance and protection of individual research task; - form of final control: differentiated credit. The final control of the level of students' knowledge is the conduct of a differentiated test, the results of which are set and equivalent to the total number of points for all types of student work during the semester. The tasks of the test include: - test tasks of different levels of difficulty, - theoretical issue of normative or problematic nature. Practical (seminar) classes, work in VNS - 40 points; scientific research tasks, abstracts, reports, participation in business or simulation games, conferences, Olympiads, draft decisions, etc. - 40 points, control work - 20 points. The semester assessment is a total assessment of the results of the PC of all types of compulsory work provided for in the work program of the discipline and the control event. This information is given to students in the first lesson.
