Learning outcomes: Integrated Competence (INT): the ability to solve complicated specialized tasks and practical problems in the field of professional legal activity or in the learning process, which involves the application of legal doctrines, principles and legal institutions and is characterized by complexity and uncertainty. General Competences (GC): GC.2. Ability to apply knowledge in practical situations. GC.3. Knowledge and understanding of the subject area and understanding of professional activity. Special Competences (SC): SC1. Ability to apply knowledge of the basics of theory and philosophy of law, knowledge and understanding of the structure of the legal profession and its role in society. SC3. Respect for human honor and dignity as the highest social value, understanding of their legal nature. SC4. Knowledge and understanding of international human rights standards, the provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms, and the case law of the European Court of Human Rights. SC7. Ability to apply knowledge of the tasks, principles and doctrines of national law, as well as the content of legal institutions, at least in such areas of law as constitutional law, administrative law and administrative procedural law, civil and civil procedural law, criminal and criminal procedural law. SC8. Knowledge and understanding of the peculiarities of the implementation and application of substantive and procedural law. SС11. Ability to identify relevant and acceptable facts for legal analysis. SС12. Ability to analyze legal issues, form and justify legal positions. SС15. Ability to prepare draft law enforcement acts independently. SС16. Ability to logical, critical and systematic analysis of documents, understanding their legal nature and significance. Professional competences (PC): PC2.1. Knowledge of procedural provisions of the constitutional legislation of Ukraine and mechanisms of their application in practice. Program learning outcomes (PO): PO2. Analyze social processes in the context of the analyzed problem and demonstrate your own vision of ways to solve it. PO3. Conduct collection and integrated analysis of materials from various sources. PO5. Give a brief conclusion on certain factual circumstances (data) with sufficient justification. PO6. Evaluate the disadvantages and advantages of arguments by analyzing a certain problem. PO9. Independently identify the circumstances in which assistance is needed and follow the recommendations received. PO17. Apply the acquired knowledge in different legal situations, highlight legally significant facts and form sound legal conclusions. PO18. Prepare drafts of necessary acts of application of law in accordance with the legal conclusion made in different legal situations. PO21. Know the mechanism of realization of human rights and freedoms. PO22. Be able to use constitutional and legal mechanisms and instruments for guaranteeing human rights, ensuring justice and democracy. Explain the nature of certain events and processes with an understanding of the professional and social context. Autonomy and responsibility (AR): AaR 1. Ability to be responsible in the work performed, to make decisions independently, to achieve the goal in compliance with the requirements of professional ethics. AaR 4. Ability to demonstrate understanding of current legislation.
Required prior and related subjects: Theory of State and Law, Constitutional Law of Ukraine.
Summary of the subject: "Constitutional process" as a discipline is of great importance in the training of future lawyers, as it is derived from constitutional law and is designed to meet the needs of its effective implementation. This discipline studies the system of procedural and legal norms that consolidate, regulate and protect the order of social relations arising in connection with the implementation of the subjects of constitutional relations of their rights and responsibilities, which are formed in the process of organization and exercise of state power. The Constitutional process is a holistic training course. Its study should be consistent and systematic. Successful study of the course of the constitutional process involves the comprehensiont of students' lecture material, its consolidation and deepening in practical (seminar) classes, independent study of normative, educational and scientific literature.
Assessment methods and criteria: Evaluation of student learning results is carried out in accordance with a 100-point score of assessment established at the university. The final assessment of the discipline consists of an assessment of the current control of learning outcomes during the semester and evaluation of learning outcomes during a control event during semester control – exam. The number of points allocated to the current control is 40 points. Examination control – 60 points. Maximum score in scores together for discipline – 100 points.
