Learning outcomes: Integral competence (INT): the ability to solve complex specialized problems and practical problems in the field of professional legal activity or in the learning process, which involves the application of legal doctrines, principles and legal institutions and is characterized by complexity and uncertainty of conditions. General competencies (GC): GC2. The ability to apply knowledge in practical situations. GC11. The ability to exercise their rights and responsibilities as a member of society, to realize the values of civil (free democratic) society and the need for its sustainable development, the rule of law, human and civil rights and freedoms in Ukraine. Special competencies (SC): SC4. Knowledge and understanding of international human rights standards, provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms, as well as the case law of the European Court of Human Rights. SC12. The ability to analyze legal issues, form and justify legal positions. SC16. The ability to logical, critical and systematic analysis of documents, understanding their legal nature and meaning. Professional competencies (PC) PC2.11. Knowledge and understanding of European standards of human rights protection. Program learning outcomes (PR): PR1 Determine the persuasiveness of arguments in the process of assessing previously unknown conditions and circumstances. PR2. Analyze social processes in the context of the analyzed problem and demonstrate your own vision of ways to solve it. PR3. Carry out collection and integrated analysis of materials from various sources. PR4. Formulate your own sound judgments based on an analysis of a known problem. PR5. Give a brief conclusion on certain factual circumstances (data) with sufficient justification. PR6. Evaluate the disadvantages and advantages of arguments by analyzing a known problem. PR29. Analyze situational plots and solve legal problems. Communication (COM) COM3. It is accessible and clear to inform the respondent about certain issues. Autonomy and responsibility (AiR) AiR1. Ability to adapt to new situations and make appropriate decisions. AiR2. Ability to realize the need for lifelong learning in order to deepen the acquired and acquire new professional knowledge.
Required prior and related subjects: The previous subjects: Theory of State and Law, Constitutional Law; International law. Related and following disciplines: Fundamentals of European Union law; International Protection of Human Rights.
Summary of the subject: «European Court of Human Rights: case law» is an integral course, the successful study of which involves students mastering lecture material, its consolidation and deepening in practical (seminar) classes, an independent study of normative, educational and scientific literature. The most important issues to be mastered during the study of this discipline are how to appeal to the European Court of Human Rights and the conditions of the application to this Court; procedure for cases consideration in the European Court of Human Rights. Following the completion of the course, students should be able to: work with national laws and international instruments on human rights, and to make an application to the European Court of Human Rights; identify the legal position set out in the judgments of the European Court of Human Rights.
Assessment methods and criteria: Evaluation of student learning results is carried out in accordance with a 100-point score of assessment established at the university. The final assessment of the discipline consists of an assessment of the current control of learning outcomes during the semester. The number of points allocated to the current control in practical (seminar) classes is 40 points, implementation of individual work – 20, test - 40. Maximum score in scores together for discipline – 100 points.
